It is simply music not subject to the rights and royalties of Authors, Performers, Producers or any public or private organization. Meaning that no royalty collection and distribution company (SPRD) can claim a fee from your client.
Without royalty, does not mean that there is no a composer behind the music. But this composer has chosen to manage his rights (which are inalienable) himself and that he’s paid differently with Phone Design.
How to get a certificate?
For each message recorded with Royalty-Free music from our library, you can download a certificate in your Customer's name and address from your ECHO Extranet.
Your customer can also download it himself on his Customer area. In case of a request from the collecting bodies (SACEM or SCPA), he will have to send them this certificate which certifies that the music broadcast on his telephone reception is indeed royalty-free.
Duration of validity
The validity of the certificate is 5 years, but can be renewed automatically for 5 new years at will. This renewal is automatic on the customer areas and on your ECHO Extranet.
What does the certificate say?
This document defines the extent of your rights relating to the use of the music that you have acquired free of charge for broadcasting over your telephone lines as part of an order for audio messages. This authorization is granted to you by XXXX STUDIO, hereinafter referred to as «the Licensor».
It is reminded beforehand that the Licensor holds the licenses to operates the musical work(s) that he distributes in digital files form, Cassettes, Audio CDs or CDROMs as referred to in appendix 1 to this authorization. These rights allow him in particular to grant this authorization within the limits defined in Article 1.
Art. 1 - AUTORIZATION In return for the global and final payment by the Authorized Party of the sums provided for in the Order Form for voice messages, the Licensor hereby grants to the Authorized Party, who accepts, the right to operates the chosen work free of charge for broadcast on his phone lines.
«Right to operate» means the use below, excluding any other:
The incorporation of the musical works referred to in Appendix 1 by the authorized person of all sound and/or voice messages, intended to be integrated into a telephone waiting system (telephone answering machine, telephone switchboard, voice servers, PABX, any telecommunications device …).
The right of adaptation or musical arrangement is excluded.
The authorized party is not authorized to grant sub-licences, even limited to the cases provided for above.
In general, he cannot rent, sell, transfer or grant rights to the work or its documentation in any form whatsoever, and to any natural person, legal entity or agencies of the same group whatsoever.
Art. 2 - GEOGRAPHICAL EXTENT The authorization will be valid for all countries of the world and for the sole account of the above-mentioned company at the address indicated.
Art.3 - DURATION This authorization is granted for a period of 5 (five) years from the date of its issue.
Art. 4 - EXCLUSIVE The Licensor does not guarantee the authorized Party any exclusivity.
Art. 5 - FAILURE This authorization terminates automatically in the event of violation by the Authorized Party of its obligations under this authorization. The Authorized should then immediately cease all distribution of the music cited in the subject.
